2. The two models in the court system are the crime control model and the due process model. Explain the philosophies of each. Which one do you believe best serves as the foundation for our court system?

3. Who do you believe is the most influential and important actor in the criminal justice process? Explain why you feel this way.

4. Do you believe plea bargaining benefits our system of justice? Why do you feel this way?

5. There are multiple ways we as a society select our trial and appellate judges. The methods differ from state to state. Which selection method do you believe is best? Defend your position.

6. What are the purposes of the exclusionary rule? What affect do you believe it has on law enforcement? Would you eliminate it? Why or why not?

7. Sentencing philosophies have shifted over time between retribution, incapacitation, deterrence, and rehabilitation. If you could write the sentencing laws for our major crimes, what theories or theory would you rely on? Think too about whether your selected theory depends upon the type of crime involved.
