PostFebruary 3, 2021On December 31, 2019, Samsonhad a very lucky day, won the lottery. Samson was marriedto Sally, and had twominorchildren: Ned, and Ted. He took his earnings and purchased two pieces of property located on Clearwater Beach and Madeira Beach on January 21, 2021. The property located on Clearwater beach was Samson and Sally’s marital home and the property had a homestead exemption. On January 31, 2021, Samson had an unlucky day and was bitten by a rare endangered but poisonous spider. Nearing the end of his life, Samsonset out to ensure that his friends and family were taken care of after his death. At the time, Samsonalso had several closefriends: Kimand Nicki.Unfortunately, Samson passed away on February 2, 2021. On February1, 2021,prior to his death,Samsonrecorded the following conveyances “I convey the property located on MadeiraBeach to Kim for life, then to Nicki.”On February 3, 2021, Kim slipped on a banana peel and fell into a coma;she passed away a few days later on February 5, 2021.On February 5, 2021, Nicki recorded the followingconveyance “I convey the property located on MadeiraBeach to my children,Thelma and Louise,as joint tenants with the right of survivorship.” Thelma and Louise fought incessantly but were happy to be new property owners. Answer the following questions. You should consider the questions independently from one another and you should presume that any conveyance discussed was properly formed, executed, and recorded.
1.Discuss theinterestthatSally, Ned,and Ted may have in the Clearwater Beach home, if any.
2.Discuss the interest, if any, that Kim and Nicki have according to the conveyance of Madeira Beach recorded by Samson.
3.Consider Nicki’s conveyance to Thelma and Louise.Is it a valid Joint Tenancy?
4.Imagine that Louise decides to sell her interest in the Clearwater Beach to fund her dream of driving cross-country in a convertible. What effect, if any, would that have on Thelma’s interest? What type of interest would Louise’s purchaser have?
