Question
Sophia has been struggling to pay her rent recently so she borrowed £1000 from her friend Imran. She has promised to pay back the whole amount on 20 February.
On 18 February, Sophia warned Imran that she could not pay back £1000 on the day the payment was due. Imran said he was happy to accept £600 in satisfaction of the whole debt if she paid him on 18 February. Three weeks later Imran demands the payment of the remaining £400.
Advise Sophia whether she has to pay back the remaining sum of £400 to Imran.

Peter is a Managing Director of Spring Garden Ltd and he wants to buy 10 mobile phones for the company’s employees. He visits the office of Best Phones Ltd and chooses the latest models. At the reception desk, he is given a contract of sale which he does not read. He simply signs the document and gives it back to the receptionist. One of the terms printed on the contract states ‘Best Phones Ltd will not be liable for any defects in any phones sold’.
After a week, the phones cannot make or receive calls and the phone batteries only last for 30 minutes.
Advise Peter whether Best Phones Ltd can reply on the exemption clause to exclude its liabilities.
